Description

Construction delays can result in substantial costs. This session will identify practical steps that a contractor can take at various stages of a project, from bid to close-out, that will increase the chance of successfully obtaining additional time and compensation. Key contract language related to delays and steps to document delay to support requests for additional time and money will be discussed.

    J.T. Gallagher is a Partner and shareholder with the law firm of Hendrick, Phillips, Salzman & Siegel, P.C., a firm specializing in providing legal services to the construction industry for more than 40 years.  Getting his initial start in construction as a plumber’s helper in high school, Mr. Gallagher has been working in the industry ever since.  He now represents contractors, subcontractors, specialty trade contractors, design professionals, and owners in relation to all aspects of public and private construction projects.

    Mr. Gallagher graduated from the University of Florida in 2006 with a Bachelor of Science in Building Construction.  After graduation, Mr. Gallagher worked as a project coordinator and project manager for a general contractor for over five years. In those roles, he delivered a variety of on-time and under-budget commercial construction projects.

    Mr. Gallagher received his J.D., with honors, from Emory University School of Law in 2014. While in law school, he completed a legal fellowship with Atlanta BeltLine, Inc. where he developed procurement policy, reviewed and drafted agreements, and assisted in dispute resolution.  After graduating from Emory Law, Mr. Gallagher worked at the Fulton County Superior Court in the Business Case Division; there, he honed his research and writing ability under the guidance of the Business Court’s four judges before beginning his practice in the construction litigation group of an Atlanta law firm.

    Mr. Gallagher has prosecuted and defended against claims, including several delay and impact claims, for construction industry clients in various forums, including arbitration, state and federal court, state claims commissions, and the United States Civilian Board of Contract Appeals. Mr. Gallagher’s clients and cases have been wide-ranging and have included: representing an EPC prime contractor in relation to a $1 billion gas liquefaction project; representing owners, general contractors, and subcontractors on multi-family housing, senior living, hospitality, distribution, and manufacturing projects; successfully protesting federal bid awards and reversing adverse status determinations for federal contracting clients, and pursuing claims for heavy civil contractors on various highway projects, including obtaining an arbitration award of over $5 million for a heavy highway subcontractor against the design-builder and simultaneously defeating a claim for $7 million in backcharges.
